Efforts to halt the results of the April 5th election to assist the schools in their efforts to educate the children in Oak Park have had their first defeat in the Cook County courts. The release from Distict 97 is below. Information Regarding Judge Mikva’s Ruling on Temporary Restraining Order May 24, 2011 – In a hearing held today in Cook County Circuit Court, Judge Mary Mikva denied the petition for a Temporary Restraining Order (TRO) that was filed by individuals who are seeking to prevent District 97 from implementing the limiting rate increase that was passed by the citizens of Oak Park on April 5, 2011. Judge Mikva denied the petition for a TRO on several grounds. She found that the balance of harms weighed in favor of the district, and did not want to stop the Board of Education from moving forward to implement the will of the voters. She also questioned whether there was any legitimate “emergency” justifying a TRO; citing that the objectors could have brought their dispute before the court at any time before the election, but instead waited until the day that the board was scheduled to adopt its supplemental levy. “We applaud Judge Mikva’s decision today, and believe it supports the fact that we have been fully transparent about the financial impact of the referendum since we adopted the resolution on January 18, 2011,” said District 97 Board President Peter Barber. “While it is unfortunate that fighting this lawsuit will force the district to waste valuable time, energy and money that should be invested in meeting the needs of the families we serve, we will not allow it to impede our efforts to build on the academic excellence that is the hallmark of our schools.” The judge did not make a final decision on the case today, which the district has asked the court to dismiss.
